1. Agreement to Terms

By accessing and using the Nautiplex platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Nautiplex's Role

Nautiplex is an online marketplace that connects customers with independent boat owners and operators ("Operators"). Nautiplex does not own, operate, crew or charter the boats listed on the platform. When you book a trip, the contract for the trip itself is between you and the Operator; Nautiplex provides the booking platform, processes payment on the Operator's behalf, and runs the support, review and reporting systems described in these terms.

3. Operator Responsibilities

Every Operator listing a boat on Nautiplex is responsible for:

• Holding every licence and registration the trip legally requires, including a professional/charter licence and registration in the Greek tourist-vessel register where Greek Law 4256/2014 applies
• Keeping valid insurance, including the third-party liability cover required by Greek law, for the whole period the boat is listed
• The seaworthiness, maintenance and safety equipment of the boat
• Providing a qualified skipper where one is required, and the conduct of their crew
• The safety of passengers on board, including the decision to cancel, delay or cut short a trip because of weather, sea state or any other safety concern
• Never carrying more passengers than the boat's certified capacity
• The accuracy of their listing: photos, specifications, prices, inclusions and availability

Operators upload their licence and insurance documents with expiry dates. When one of those documents expires, new bookings for that boat are paused automatically until a current document is provided.

4. Customer Responsibilities

As a customer you are responsible for:

• Booking for the correct number of guests and never exceeding the boat's stated capacity
• Following the skipper's and crew's safety instructions at all times, including wearing life jackets when instructed
• Arriving on time at the stated departure point
• Your own conduct and that of your guests, and any damage you or your guests cause to the boat or its equipment
• Telling the Operator in advance about any medical condition, mobility need or non-swimmer in your party that affects safety

5. Age Requirements and Minors

You must be at least 18 years old to book a trip on Nautiplex, and at least 13 years old to create an account. Guests under 18 may take part in a trip only when accompanied on board by a parent or legal guardian, or by an adult who has the guardian's permission and takes responsibility for them. Some activities (for example, some watersports or party events) are restricted to adults; this is stated on the listing, and the Operator may refuse boarding to anyone who does not meet the listed age requirement.

6. Cancellations and Right of Withdrawal

Boat trips are leisure services booked for a specific date. Under Article 16(l) of the EU Consumer Rights Directive (2011/83/EU), the 14-day right of withdrawal therefore does not apply to bookings made on Nautiplex. Instead, the cancellation and refund terms in our Refund Policy apply. If the Operator cancels your trip for any reason, including weather or safety, you receive a full refund.

7. Reviews

Only customers who completed a trip booked through Nautiplex can review it, and each booking can be reviewed once. Operators can publish a public reply to a review but cannot edit or remove it. Nautiplex does not pay for, commission or edit reviews, and does not offer incentives for positive reviews. We may remove reviews that break the law or contain abuse, personal data or content unrelated to the trip; you can report a review through the Report an Issue page.

8. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Nautiplex's platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on the platform
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

9. Disclaimer

The materials on Nautiplex's platform are provided on an 'as is' basis. Nautiplex makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

10. Limitations

In no event shall Nautiplex or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Nautiplex's platform, even if Nautiplex or an authorized representative has been notified orally or in writing of the possibility of such damage.

11. Accuracy of Materials

The materials appearing on Nautiplex's platform could include technical, typographical, or photographic errors. Nautiplex does not warrant that any of the materials on its platform are accurate, complete, or current. Nautiplex may make changes to the materials contained on its platform at any time without notice.

12. Links

Nautiplex has not reviewed all of the sites linked to its platform and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Nautiplex of the site. Use of any such linked website is at the user's own risk.

13. Changes to These Terms

We may update these terms from time to time. Each version is dated and numbered at the top of this page, and we record which version you accepted when you created your account. For material changes we will notify registered users by email or in the app before the new version takes effect. Bookings already confirmed stay governed by the version in force when you booked.

14. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Greece, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

15. Copyright / DMCA Policy

Nautiplex respects the intellectual property rights of others and expects users of the platform (boat owners uploading listing photos, customers posting review images, etc.) to do the same. We respond to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

If a takedown removes your content and you believe it was removed in error, you may submit a counter-notice to the same address identifying the removed material and including a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
